What is Probate? When a person dies nearly all estates need to
under go Probate.
Probate is a term commonly used in the UK when talking about
applying for the right to deal with a deceased person's affairs or a
Probate Grant (called 'administering the estate').
There are three stages to dealing with an estate.
- Finding out exactly what the estate consist of and what
value it is
- Obtaining the relevant Grant, Grant of probate if there is a
will or Grant of Letters of Administration, where there is no
Will (intestacy)
- Distributing the estate in accordance with the Will or the
law.
When you create your will you need to appoint Executors. to
undertake the duties listed above. It is common for people to
consider appointing a close family member or friend as Executors.
In some circumstances this where the estate is very simple and
the wishes are easy to executor with no likelihood of contention
this may be a valid thing to do, but we believe it is worth
considering appointing a professional Executor rather than a family
members or friend.
